Agreement to terms

These Terms apply to all users of OnDemand.Website, including visitors, customers who have submitted the intake form, and subscribers with an active hosting plan.

The service

OnDemand.Website is a managed static website hosting service operated by Aldis Cloud Inc., a federally incorporated Canadian company. The service builds and hosts static websites for small and medium-sized businesses in Canada and the United States.

The service includes:

• A custom static website built from your intake form submission
• A preview website hosted at a subdomain of OnDemand.Website, provided at no charge before subscription
• Production website hosting on your free ondemand.website address or a custom domain you purchase
• A free public URL at yourname.ondemand.website included with every plan
• Optional custom domain purchase and management, available from your dashboard
• SSL certificate provisioning and renewal
• DNS management
• Email and SMS notifications at key milestones

The service is designed for static websites. Dynamic sites, CMS-based sites (WordPress, Drupal, etc.), server-side applications, and ecommerce platforms are outside the scope of OnDemand.Website.

Accounts

You must create an account to use the service. You must provide accurate, current, and complete information during account creation. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

Notify us immediately at support@OnDemand.Website if you believe your account has been compromised. We are not liable for losses resulting from unauthorised use of your account where you have not notified us promptly.

We may suspend or terminate accounts created with false information, or accounts used in violation of these Terms, without prior notice.

Preview websites

After submitting the intake form, we will build a preview website based on the information you provide. The preview is hosted at a subdomain of OnDemand.Website (for example, acmeplumbing.OnDemand.Website) and is provided at no charge before any subscription is required.

Preview websites are not indexed by search engines. Preview websites are taken offline 30 days after your subscription is activated. If you do not subscribe, your preview may be taken offline at Aldis Cloud's discretion without prior notice. We do not guarantee any minimum availability period for preview websites prior to subscription.

The preview is built from the information you provide in the intake form. Aldis Cloud exercises reasonable effort to reflect your preferences, but the preview is a first draft. Revisions are available as described below.

Revisions and updates

Preview revisions

You may submit revision requests for your preview website through your account dashboard. You may submit one revision request per day. Each request may include as many individual changes as you wish. There is no charge for revisions to the preview website prior to your first Go Live.

Post-launch updates

After your website goes live, you may request changes and updated versions through your account at any time. There is no per-publish fee. Changes are applied as part of your subscription.

Update fees are charged separately from your subscription and are billed at the time of each publish request. You decide when to push an updated version live.

Subscription and billing

Subscriptions are billed via Stripe in Canadian dollars (CAD) for Canadian customers and in US dollars (USD) for all other customers; plan amounts are the same number in both currencies. The following plans are available:

Included custom domain (annual plans). Each annual subscription includes one custom domain registration: a standard domain whose registration price is CAD/USD $25 or less per year, chosen and registered by you from your dashboard. The inclusion covers the initial registration term only; renewal is billed annually at our standard domain price from the following year. The inclusion is one per annual subscription, is not transferable, has no cash value, and is not refundable or exchangeable if unused. Domains priced above $25/yr and premium domains may be purchased at the normal price.

Enterprise pricing. Enterprise plan prices shown are starting prices for the standard plan. Custom services — including third-party integrations, dedicated or custom hosting arrangements, professional services, and technical consulting — are scoped, quoted, and delivered under a separate written agreement, and are not included in the plan price.

Annual plans are billed as a single upfront payment for the full year. Annual plans are non-refundable except as required by applicable Canadian consumer protection law.

Monthly plans may be cancelled at any time. Cancellation takes effect at the end of the current billing period. No partial-month refunds are provided.

No setup fees apply to any plan. Applicable taxes (GST/HST for Canadian customers) are added at checkout via Stripe Tax.

We reserve the right to change subscription pricing. Existing subscribers will receive at least 30 days' written notice before any price change takes effect.

Custom domains

Every plan includes a free public URL at yourname.ondemand.website. Custom domains (.com, .ca, and other TLDs) are available as a separate purchase from your dashboard.

Domain purchases involve two charges:

• Registration fee — a one-time charge at the time of purchase. This registers the domain on your behalf. The amount varies by TLD and is displayed before you confirm the purchase. Registration fees are non-refundable once the domain is registered.
• Annual renewal fee — a recurring charge billed once per year to keep the domain active. The renewal rate is displayed at the time of purchase and may be updated at renewal with 30 days notice. Renewal fees are charged automatically unless you cancel the domain renewal at least 30 days before the renewal date. If renewal is not paid, the domain will expire and become available for others to register.

Both charges appear as separate line items in your account. The annual renewal subscription is listed on your Subscriptions page alongside your website plan.

Billing failures

If a payment fails, we will notify you by email and attempt to process the payment again. If payment remains outstanding after reasonable attempts, we may suspend or terminate your service. Any custom domains you have purchased will not be deleted or transferred as a result of website subscription billing failure. DNS management for custom domains may be paused until payment is resolved. Domain renewal fees are billed separately and failure to pay renewal fees may result in domain expiry regardless of the status of your website subscription.

Domain registration

Every subscription includes a free public URL at yourname.ondemand.website. Custom domains are an optional separate purchase made through your dashboard. When you purchase a custom domain, Aldis Cloud registers it through its registrar account with NameSilo and holds it as the registrant of record on your behalf. Your contractual right to the domain is yours at all times, including the right to request a transfer. Aldis Cloud manages it on your behalf for operational convenience.

Auto-renewal and expiry

Custom domains are renewed automatically and billed as an annual recurring charge separate from your website subscription. You will be notified by email at least 30 days before each renewal date. If you do not wish to renew, you must notify us at least 30 days before the renewal date via your dashboard or by emailing support@OnDemand.Website.

If a renewal payment fails, we will notify you and attempt to retry. If the renewal fee remains unpaid after reasonable attempts, the domain will be allowed to expire. An expired domain is no longer under your control and may become available for registration by third parties. Aldis Cloud is not liable for loss of a domain name resulting from non-payment of renewal fees.

You may cancel auto-renewal at any time from your dashboard. Cancelling auto-renewal does not result in a refund of any previously paid registration or renewal fees.

On cancellation

If you cancel your website subscription, your live website moves back to preview mode and is no longer publicly accessible. Your free ondemand.website URL will be decommissioned. Any custom domains you have purchased remain registered on your behalf and continue to renew annually until you cancel them. Aldis Cloud will retain DNS management until you initiate a transfer or the domain expires. To transfer a custom domain away from Aldis Cloud's registrar account, contact us at support@OnDemand.Website. Transfer procedures and any registrar fees are subject to NameSilo's policies at the time of transfer. If you do not transfer or renew a domain after cancelling your subscription, it will expire at its next renewal date.

WHOIS and ICANN

Domains are registered by Aldis Cloud as the registrant of record on your behalf. Your personal name and contact information are not submitted to the registrar and do not appear in public WHOIS records.

Your content

You retain all rights to the content you provide to Aldis Cloud, including your business name, logo, images, text, and other materials submitted through the intake form.

By submitting content, you grant Aldis Cloud a limited, non-exclusive licence to use, store, process, and display that content solely for the purpose of building, hosting, and maintaining your website. We do not use your content for any other purpose.

You represent and warrant that you own or have the necessary rights to all content you submit, and that your content does not infringe the intellectual property rights of any third party.

Your responsibility for backups

You are solely responsible for maintaining independent backup copies of any content, data, images, or files you submit to Aldis Cloud or that appear on your website. Aldis Cloud is not responsible for archiving or preserving your content beyond what is required to deliver the service. In the event of data loss, Aldis Cloud will use reasonable efforts to restore your website from available records, but makes no guarantee of complete recovery. We strongly recommend you retain copies of all original files, images, and content used to build your website.

Acceptable use

You may not use OnDemand.Website to host, distribute, or promote content that:

• Is illegal under Canadian or applicable law
• Infringes the intellectual property rights of others
• Contains malware, phishing content, or deceptive material
• Promotes hate, violence, harassment, or discrimination
• Violates the privacy of any individual
• Constitutes spam or unsolicited commercial communication
• Impersonates any person or organisation

We reserve the right to take down any website or content that violates these Terms without prior notice. Repeated or severe violations may result in account termination without refund.

Uptime and availability

Aldis Cloud targets 99.9% uptime for all production hosted websites. This target is an operational goal and does not constitute a binding service guarantee under the base subscription. No credits or remedies are available under the base uptime target alone.

An optional SLA add-on is available for all subscription tiers. The SLA add-on converts the uptime target into a binding contractual commitment with defined credits and remedy procedures. SLA add-on terms are governed by a separate agreement available on request.

Aldis Cloud is not responsible for downtime caused by third-party infrastructure providers (including Microsoft Azure), scheduled maintenance communicated in advance, DNS propagation delays, or events outside our reasonable control.

Intellectual property

OnDemand.Website, the Aldis Cloud name, and all associated branding, software, and platform infrastructure are owned by Aldis Cloud Inc. and protected by applicable intellectual property laws. Nothing in these Terms grants you any rights in Aldis Cloud's intellectual property.

The static website generated for you is based on your content and is yours. Aldis Cloud does not claim ownership over the output website generated from your intake form data.

Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Aldis Cloud does not warrant that the service will be uninterrupted, error-free, or free of harmful components. We do not warrant that the website we build for you will achieve any particular business outcome.

Limitation of liability

To the maximum extent permitted by applicable law, Aldis Cloud's total liability to you for any claim arising from or related to the service is limited to the total amount you paid to Aldis Cloud in the three calendar months immediately preceding the claim.

Aldis Cloud is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, loss of business opportunity, or business interruption, even if Aldis Cloud has been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be excluded under applicable Canadian consumer protection law.

Indemnification

You agree to indemnify, defend, and hold harmless Aldis Cloud Inc. and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the service, your content, or your violation of these Terms.

Termination

By you

You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of the current billing period. Your website will be taken offline at that time.

By Aldis Cloud

We may suspend or terminate your account and hosting service for breach of these Terms, non-payment, illegal activity, or any use we determine to be harmful to the service or other users. We will provide reasonable notice except where immediate termination is required to protect the service or other users.

Effect of termination

Upon termination, your production website will be taken offline and your free ondemand.website URL will be decommissioned. Your website returns to preview mode temporarily before full decommission. Any custom domains you have purchased remain registered on your behalf and will continue to renew annually unless cancelled. Your account data will be retained for up to one year before permanent deletion, during which time you may request a copy of your data.

Changes to these terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify active subscribers by email at least 14 days before the change takes effect. Continued use of the service after a change is posted constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Aldis Cloud Inc. is incorporated and operates, and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the service will be subject to the jurisdiction of the applicable courts in Aldis Cloud's jurisdiction of incorporation. If you are a consumer, you may also have rights under consumer protection legislation in your province or state of residence that cannot be waived by these Terms.
